Dear Ms. Walker:

i in a June 10,1998, letter, you requested that we verify our approval of your Remediation Plan for the Harshaw Chemical Company site at 1000 Harvard Avenue, Cleveland, Ohio. You also asked us to confirm that the existing clean-up levels described in the Plan were still acceptable.

Although not stated in your letter, during a May 26,1998, telephone cati between you and Mr. William Snell of my staff, you had indicated you would be sending this letter to obtain i

assurance that your previously approved release levels would still be valid even though the new 10 CFR Part 20, Subpart E " Radiological Criteria for License Termination," would be taking effect on August 20,1998.

i 10 CFR Part 20, Subpart E, Section 20.1401(b)(2) states that if you have a decommissioning plan that has been previously received and approved by the Commission prior to August 20, 1998, and that plan is compatible with the SDMP Action Plan criteria, then Subpart E does not apply. By letter dated June 12,1995, we provided you written confirmation of our approval of your Remediation Plan. Our review of your Plan leading up to that June 12 letter essentially confirmed that your Plan was compatible with the SDMP Action Plan criteria. Therefore, your Plan is still approved for use at the Harshaw Chemical Company site at 1000 Harvard Avenue, in Cleveland, Ohio, and the unrestricted release levels described in the Plan are also acceptable for I

completion of the remediation.
