{ WASHINGTON, D. C. 20555

.....p# November 10, 1987 j CHAIRMAN j

The Honorable J. Bennett Johnston  !

Chairman, Comittee on Energy and Natural Resources j United States Senate i Washington, D.C. 20510

{

Dear Mr. Chairman:

q t

This responds to'your letter of November 9,1987, in which you requested i the Nuclear Regulatory Commission's views on legislation that would ,

require the Secretary of Energy to select by January 1,1989, a single j preferred site for characterization as a repository from among the three q current candidate sites. J a

The Commission's views continue to be those that we expressed in an l October 2, 1987 letter to you. Simply put, the Commission does not oppose '

legislation that would require the Secretary of Energy to select one site j for at-depth characterization. Simultaneous characterization of three j sites is not necessary to protect the public health and safety. The ,

Comission takes no position concerning the date for selecting a preferred  !

site for characterization. However, it should be recognized that {

sequential site characterization could delay the schedule for opening.a  ;

repository if the preferred site is subsequently found to be unlicensable. 1 To mitigate this concern we have suggested that surfac-based testing l continue at the two sites not selected for at-depth characterization.  !

This is the approach reflected in your amendment to S.1668. Please  !

contact me if we can be of further assistance. 1 Sincerely, i

b. k Lando W. Zech, . l cc: Hon. James A. McClure l l
