Gentlemen:

Please be advised that the Town Board, at a meeting held on November 10, 1987 adopted the following resolution:

WHEREAS, the Nuclear Regulatory Commission has' adopted a rule  ;

concerning evacuation plans and the licensing of nuclear power g plants which eases the requirement of state and local approval a and participation, and WHEREAS, said rule is contrary to the interest of the people 9

/ of the Town of Southampton because it endangers their health, }

safety and welfare, and .

WHEREAS, said rule may facilitate the opening of the Shoreham Nuclear Power Station without a locally approved evacuation plan in direct opposition of Town policy opposing the *(

licensing of said plan, and WHEREAS, said rule violates state law and the U.S. Constitution by infringing on the police power of local government, and WHEREAS, New York State and Suffolk County are commencing legal 0 action contesting the new N.R.C. rule, l NOW, THEREFORE, BE IT l RESOLVED, that the Town of Southampton does hereby support the l State and County actions to invalidate the N.R.C. rule. c Sincerely yours, DS10:
