JAMES A. FITZPATRICK NUCLEAR POWER PLANT- EVALUATION OF THE HISTORICAL LICENSING BASIS FOR REQUESTS FOR EXEMPTION FROM THE REQUIREMENTS OF APPENDIX R TO 10 CFR PART 50 (TAC NO. M/,0255)

Dear Mr. Knubel:

In a safety evaluation (SE) issued on September 5,1995, the NRC staff stated that exemptions were needed from certain technical requirements of Section lit.G and Section Ill.L of Appendix R to Part 50 of Title 10 of the Code of Federal Regulations (10 CFR Part 50) to use low pressure injection systems from the control room in the event of a fire in certain fire areas at the James A.

FitzPatrick Nuclear Power Plant. As a result, on January 12,1996, the New York Power Authority (NYPA also known as the Power Authority of the State of New York), requested exemptions for six fire areas (Fire Areas IX, X, XI, XV, XVil, and XVill).

On December 18,1996, the NRC staff requested additionalinformation regarding NYPA's exemption requests. In a meeting between the staff and NYPA representatives on October 6, 1997, NYPA indicated that the use of low pressure injection systems had been previously reviewed and approved by the staff for four of the six fire areas for which it had requested exemptions. At the time of the meeting, documentation sufficient to confirm previous NRC approvals was not available for review. Subsequently, NYPA provided copies of previously-docketed information that supported its position to the staff and the Brookhaven National Laboratory (BNL).

BNL evaluated the fire protection licensing basis for each of the six fire areas under consideration, and on January 13,1998, issued to the NRC the results of its evaluation (enclosed). The staff has reviewed the BNL evaluation and have concluded the following: ]

Fire Area IX (Reactor Building East Side, Elevation 272 ft. - formerly Fire Zone RB1A)

. Fire Area X (Reactor Building West Side, Elevation 272 ft. - formerly Fire Zone RB1B)

. Fire Area XVil (Reactor Building East Crescent Area - formerly Fire Zone RB1E)

. Fire Area XVill (Reactor Building West Crescent Area - formerly Fire Zone RB1W)

Based on an NRC staff safety evaluation issued by letter dated July 1,1983, and an j

exemption granted byletter dated September 10,1992, the NRC staff approved use oflow pressure injection systems as a means of accomplishing post-fire safe shutdown for Fire Area XV (T0rus - formerly Fire Area SU-1).
