NRC INSPECTION REPORT 70-7002/98011(DNMS) AND NOTICE OF VIOLATION

Dear Mr. Miller:

On July 20,1998, the NRC completed a routine resident inspection at your Portsmouth Gaseous Diffusion Plant. The enclosed report presents the results of that inspection. The results of our inspection over a six-week period covered by the enclosed report indicate that the conduct of activities at the Portsmouth Gaseous Diffusion Plant was generally adequate.

Based upon the results of the inspection the NRC has determined that violations of NRC requirements occurred. The violations are cited in the enclosed Notice of Violation (Notice) and the circumstances surrounding the violations are described in detail in the enclosed report. The first violation involved a failure to implement corrective action to prevent an unnecessary challenge to an autoclave safety system. The second violation involved the use of an engineering evaluation to replace procedural requirements without performing an adequate safety review. The third violation involved a failure to report a potential compromise of classified material in a timely manner. Together, the violations are a concem because they indicate a lack of rigor in resolving ongoing plant issues.

. You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. The NRC will use your response, in part, to

. determine whether further enforcement action is necessary to ensure compliance with regulatory requirements.
