Dear Congressman Gephardt:
I am responding to your October 13, 1987 letter in which you urged the Commission not to approve any operating licenses fer the Seabrook Nuclear Reactor until the matter of State and local government participation in emergency planning can be addressed.
Pursuant to the requirements of the Atomic Energy Act and the Commission's own rules, the Commission's decisions in a contested licensing proceeding are made on the basis of the formal adjudicatory record.
Because the subject you raise is at issue in a Commission adjudicatory proceeding, a copy of your letter has been served on all parties to that proceeding.
A copy has also been placed in the NRC's Public Document Room.
I am sure you will understand that the Commission cannot respond more fully at this time to the substance of your concerns.
The Commission's decision in this natter will be rendered on the formal record of the Seabrook proceeding.
I can assure you, however, that in reaching this decision, the Commission's primary consideration will be protecting public health and safety.
