NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Consumers Power Company (Big Rock Point Nuclear Power Plant)

Subject:
PROPOSED IMPOSITION OF CIVIL PENALTY - $25,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Twenty-Five Thousand Dollars
($25,000) will be issued on or about December 2, 1987 to Consumers Power Company. This action is based on a violation involving failure to maintain control of access to a vital area of the plant.
In assessing the proposed civil penalty the licensee's prior good enforcement history, including Category 1 ratings in Safeguards in the Systematic Assessment of Licensee Performance (SALP), was balanced against the failure to identify the viola-tion over a long period of time in spite of several specific opportunities to do so and prior notice of similar events.
As a result, the base amount of the civil penelty was mitigated by 50%.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

The State of Michigan will be notified.
l The licensee has thirty days from the date of the Notice in which to respond.
I Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
