PROPOSED IMPOSITION OF CIVIL PENALTY - $25,000 '

This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Twenty-Five Thousand Dollars

($25,000) will be issued on or about December 2, 1987 to Consumers Power Company. This action is based on a violation involving failure to maintain control of access to a vital area of the plant. In assessing the proposed civil penalty the licensee's prior good enforcement history, including Category 1 ratings in Safeguards in the Systematic Assessment of Licensee Performance (SALP), was balanced against the failure to identify the viola-tion over a long period of time in spite of several specific opportunities to do so and prior notice of similar events. As a result, the base amount of the civil penelty was mitigated by 50%.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
