SUBJECT:

EXEMPTION FRON REQUIREMENTS FOR AMENDMENT FEES This is in response to your memorandum dated August 20, 1996, to Diane Dandois, of my staff, requesting an exemption from amendment fees for those license amendments filed by and issued to portable gauge licensees to change the Radiation Safety Officer (RS0).

We have determined that the amendments will be exempt from 10 CFR Part 170 fees after the newly-developed portable gauge guidance is issued based on your statements that:

1) there is no technical. review associated with issuance of amendments to change the name of RS0s on the license; 2) the issuance of the amendments is an administrative matter; and 3) maintaining knowledge of the identity of the current RSO through a license amendment is for the convenience of the Commission. We understand that this new procedure is a change from past practice whereby the licensee would now submit only the name of the replacement RSO without having to provide supporting information about training and experience for NMSS technical review. This change is based on revised guidance for portable gauge licensees (approximately 1,200) which is the result of the Business Process Reengineering process whereby NMSS is now I

taking a graded, more performance-based approach for regulating this category j

of licensees.

This exemption is authorized by law and is granted in accordance with sl70.11(b)(1) of 10 CFR Part 170. Please note that Part 170 fees will be I

assessed in those instances where the amendment request would need technical review by the NMSS staff, and for amendments to those licenses which authorize other activities in addition to the use of portable gauges.

In the FY 1997 proposed rule, OC intends to make this a specific exemption in 9170.11. You indicate in your memorandum that as new or revised guidance.for.

pther categories' of licenses is prepared there may be additional types of-administrative amendments that will not require technical review. We would appreciate it.if you could identify those amendments by October 31, 1996, which would provide my staff enough time to include them in the FY 1997 proposed rule, if you have.any questions concerning this matter, please call C.
