Subject:

Inspection No. 70-687/87-04 This refers to the Operational Safety Review conducted by Mr. J. Roth, other membersoftheNRCRegionIandHeadquartersstaffandNewYorkStateDepart-ment of Labor representatives on May 18-22, 1987, of conditions in your facilities on the Tuxedo, New York site to determine whether there are poten-tial safety hazards that, when combined with facility operations, could adversely impact upon the health and safety of the public or workers at the facilities. The inspection consisted of selective examination of procedures, processes, and representative records, interviews with personnel, and obser-vations by members of the team.

Five' violations of NRC requirements were identified and are described in Appendix A. Please reply to this in accordance with the instructions in that Appendix. That reply is not subject to clearance by the Office of Management and Budget under the Paperwork Reduction Act of 1980, PL 96-511.

In addition to the violations described in Apnendix A, the team observed a number of conditions related to your facilities that warrant the attention of management. We would request a response from you describing the actions you have taken or plan to take, relative to the observations and recommendations included in the enclosed inspection report. Further, we request that you maintain documentation relative to your actions so that the NRC and other responsible federal agencies can follow your progress in resolving these matters.

In general we found that you have adequately addressed the work control prac-tices and overall management controls required by your NRC facility license with the exception of those items discussed in Appendix A to this letter.

Although there do not appear to be any hazards associated with your facility operation that could have a significant offsite impact on the public, we are concerned about your management controls with regard to fire safety, indus-trial safety, radiation safety, training and emergency planning. In addition, we are concerned about your administrative controls, e.g. policies and proce-dures, that allowed five violations of federal requirements to be identified during a review of your operations that was focused predominantly on an evaluation of operational safety rather than on compliance. In your response, please specifically address those actions that will be taken to improve administrative controls at your facility.
