l H:\\DPA\\8715_OSP.LET Dear Mr(s) XXXX I am writing to request your comments on the enclosed advance notice of proposed rulemaking (ANPR) which has recently been approved for publication in the Federa/ Register.

This ANPR requests public comments on whether the NRC should proceed with rulemaking to modify the power reactor event reporting requirements in 10 CFR 50.72 and 50.73 and, if so, the general nature of the modifications that should be made. Several concrete proposals are also provided for comment, including a proposed clarification for reporting of design issues and a proposed extension of required reporting times, consistent with the NRC's needs for prompt reporting. The ANPR also requests comments on other reactor reporting requirements that could be simplified and/or made less burdensome and more risk-informed.

As discussed in the enclosed staff requirements memorandum, many States (Agreement States and Non-Agreement States) have agreements with power reactors to inform the States of plant issues. State reporting requirements are frequently triggered by NRC reporting requirements. Accordingly, the NRC seeks State input on issues related to amending power reactor reporting requirements.

There will be a public meeting to discuss the ANPR, beginning at 9:00 a.m. on August 21,1991 in the Auditorium at NRC headquarters,11545 Rockville Pike, Rockville, Maryland 20852.

There will also be a public meeting to discuss the role of the nuclear industry in regulation, l

beginning at 8:00 a.m. on September 1,1998, at the Hyatt Regency O' Hare Hotel,9300 West Bryn Mawr Avenue, Rosemont, Illinois 60018. This second meeting willinclude a breakout session to discuss modification of power reactor reporting requirements, along with other subjects. As discussed in the ANPR, written comments may be mailed, or delivered, or sent electronically and are requested within 60 days after publication of the ANPR.

STAFF REQUIREMENTS - SECY-98-036 - RULEMAKING TO MODIFY EVENT REPORTING REQUIREMENTS FOR POWER REACTORS The Commission has approved the proposed rulemaking to modify the event reporting requirements of 10 CFR 50.72 and 10 CFR 50.73. Public comments on the rulemaking schedule should be solicited as well as comments on the content of the proposed rule.

Many States (Agreement States and Non-Agreement States) have agreements with power reactors to inform the States of plant issues. State reporting requirements are frequently triggered by NRC reporting requirements. The staff should seek State input on proposed changes to the power reactor reporting requirements.

The staff should evaluate current regulations to identify areas where event reporting requirements can be risk-informed and/or simplified. For example, the time limit for reporting could be adjusted based on the safety significance of the event and the need for NRC's immediate action. The burden associated with reporting events or conditions with little or no safety or risk significance should be minimized. The staff should request industry identification of other reporting requirements that are potential candidates for modifying to a more risk-informed approach in the planned ANPR on 6 50.72, and include this issue in the agendas for the upcoming workshops on S 50.72 and DSI 13. Based on the results from these workshops, a schedule and plan of action should be submitted to the Commission. The staff should also consider the merits of using criteria similar to that developed by the Special Projects Office in establishing thresholds for categorizing design deficiencies.

If practical, the staff should coordinate the revised reporting with the implementations of ADAMS, to facilitate the use of electronic notifications, when appropriate.

Any changes resulting from this proposed rulemaking should be consistent with agency actions to improve integrated plant assessments.
