Dear Mr. McIntyre:
By Westinghouse letter NTD-NRC-95-4411, dated February 28,1995, you submitted an AP600 -

report titled: "WCOBRA/ TRAC Core Makeup Tank Preliminary Validation Report." In your letter, l
you stated that certain information in this report was considered proprietary and requested that it l
be withheld from public disclosure pursuant to 10 CFR 2.790. Although the report was not bracketed to indicate the specific aspects considered proprietary, you stated that the report was preliminary and that with publication of the final report, the preliminary identification would be removed an a non-proprietary version prepared.
I Affidavit AW-95-785 executed by Henry A. Sepp on March 2,1995, claims, in part, that the information in the AP600 WCOBRA/ TRAC core makeup tank preliminary validation report is l
classified as proprietary because "[t]he development of the technology described in part by the information is the result of applying the results of many years of experience in an intensive j
Westinghouse effort and the expenditure of a considerable sum of money." in addition, the affidavit also states that this information should be considered exempt from mandatory public disclosure for the following reasons:
a.
The information reveals the distinguishing aspects of a process (or component, structure, tool, method, etc.) where prevention of its use by any of Westinghouse's competitors without license from Westinghouse constitutes a competitive economic advantage over other companies.

It consists of supporting data, including test data, relative to a process (or component, structure, tool, method, etc.), the application of which data secures a competitive economic k D advantage, e.g., by optimization or improved marketability.
l c.
Its use by a competitor would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, y
or licensing a similar product.

We have reviewed the subject material in accordance with the requirements of 10 CFR 2.790.
However, the staff was unable to locate a final version of the AP600 WCOBRA/ TRAC core makeup tank validation report. Since the material in your February 28,1995, letter was not bracketed and a non-proprietary version of the report was not located, the staff could not complete its proprietary determination.
l You are requested to review your claim and to notify the staff of what portions of the material, if any, are still considered proprietary. If the information is not received, then, in accordance with 10 CFR 2.790(c), the report, marked as proprietary and attached to your letter, will be placed in the NRC Public Document Room thirty (30) days from the date of this letter. If within thirty (30) 1 days of this letter, you request withdrawal of these documents in accordance with 10 CFR 2.790(c), or provide additional reasons for the withholding of information from the documents identified in the enclosure to this letter, your request will be considered in light of applicable statutes and regulations and a determination made whether the documents will be withheld from public disclosure or returned to you.
