~ REQUEST FOR WITHHOLDING PROPRIETARY INFORMATION FOR WESTINGHOUSE LETTERS DATED APRIL 18,1995
Dear Mr. McIntyre:
~ By Westinghouse letter NTD-NRC-95-4440, dated April 18,1995, you submitted a -
MAAP4/RELAP comparison for the AP600 in response to a staff request for additional information. The attached affidavit (AW-95-813) executed by you on April 18,1995, indicates that Westinghouse considers some of the materialin this response proprietary.
We have reviewed the subject materialin accordance with the requirements of 10 CFR 2.790, however, the staffis not able to determine which portions of the material Westinghouse wishes to be withheld from public disclosure. Specifically, the cover letter indicates that Enclosure 2 is a non-proprietary version of Enclosure 3, however, the staff could not find any portion of the
- Enclosures marked as proprietary. The conventional bracketed-superscript notation also appears to be missing. Further, the staff could not determine which part of the material enclosed with the letter was Enclosure 1,2, or 3.
You are requested to review your claim and to notify the staff of what portions of the material, if any, are still considered company proprietary. If the information is not received, we intend to place the subject document in the NRC Public Document Room in 30 days from the date of this letter. If within thirty (30) days of this letter, you request withdrawal of these documents in accordance with 10 CFR Section 2.790(c), or provide additional reasons for the withholding of information from the documents enclosed, your request will be considered in light of applicable statutes and regulations and a determination made whether the documents will be withheld from public disclosure or retumed to you.
