REQUEST FOR WITHHOLDING PROPRIETARY INFORMATION - WCAP-14407, "WGOTHIC APPLICATION TO AP600," REVISION 3 By letter NSD-NRC-98-5682, dated May 1,1998, Westinghouse submitted Revision 3 to WCAP-14407,"WGOTHIC Application to AP600." This revision contained change pages and a l new Appendix 4.B. Westinghouse requested that Appendix 4.8 be withheld from public disclo-sure in its entirety. The request was made in accordance with 10 CFR 2.790 and is supported by

affidavit AW-98-1231 executed by you on May 1,1998, which claims, in part, that the information is classified as proprietary because "The development of the technology described in part by the information is the result of applying the results of many years of experience in an intensive Westinghouse effort and the expenditure of a considerable sum of money." in addition, your affidavits identify the following reasons

I a. The information reveals the distinguishing aspects of a process (or component, structure, l tool, method, etc.) where prevention of its use by any of Westinghouse's competitors without license from Westinghouse constitutes a competitive economic advantage over other companies.

c. Its use by a competitor would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing a similar product.

We have reviewed the document you submitted in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have determined that the information sought to be withheld contains trade secrets or proprietary commercialinformation. Therefore, Appendix 4.B of WCAP-14407, Revision 3, will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

A revision to WCAP-14408, "WGOTHIC Application to AP600," identified as Westinghouse Non- O Proprietary Class 3, reflecting the recent changes has not been received by the NRC. Therefore, 1 you need to provide an update to WCAP-14408 within 30 days of the date of this letter. )

l Withholding from public inspection shall not affect the right, if any, of persons properly and directly concemed to inspect the document. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
