REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE FOR WESTINGHOUSE AP600 DESIGN LETTERS
Dear Mr. McIntyre:
Enclosed with this letter is a table of Westinghouse letters you have submitted to the Nuclear Regulatory Commission (NRC) staff which contain proprietary materialin support of the AP600 design certification.
In documentation attached to these letters, you identify information which you consider proprietary with a Westinghouse Proprietary Class 2 header on top of each page. Most of the letters request that the proprietary information be withheld from public disclosure pursuant to 10 CFR 2.790 with accompanying affidavits which claim, in part, that the information is classified as proprietary because "[t]he development of the technology described in part by the information is the result of applying the results of many years of experience in an intensive Westinghouse effort and the expenditure of a considerable sum of money." Those letters with affidavits do not always provide a detailed justification as to why the proprietary information should be considered exempt from mandatory public disclosure with conventional bracketed-superscript notation, as specifically noted on the enclosed table. Some of the documents marked proprietary did not include an affidavit in the submittal letter. In addition, other problems have been noted on a case-by-case basis.
Because of deficiencies in each of the proprietary applications, as detailed in the enclosed table, the staff is unable to complete its proprietary determination review. In accordance with 10 CFR 2.790(c), this letter is being forwarded to you as notice that the documents, marked as proprietary and attached to the letters identified in the enclosed table, will be placed in the NRC Public Document Room thirty (30) days from the date of this letter if the noted deficiencies are not corrected. If within thirty (30) days of this letter, you request withdrawal of these documents in accordance with 10 CFR 2.790(c), or provide additional reasons for the withholding of C'\\\\
