4 APPLICANTS' RESPONSE TO CASE'S MOTION FOR A PROTECTIVE ORDER (INTERROGATORIES 1987-9) AND MOTION TO COMPEL In its response to the interrogatories propounded to it and designated as Set 1987-9, CASE has included a motion for a protective order.

The questions propounded in Set 1987-9, like those set forth in Sets 1987-1,~2, 3,

5 and 8, followed a pattern.

Selected relevant portions of completed CPRT Results Reports, and asked CASE to state its position with respect to the L

results and, if its position were other than agreement, to disclose its basis (if any) for disagreement.

In its Me'morandum and Order (Acolicants' Motion to

'Comoel) of March 30, 1987, the Board denied a motion to compel in respect of Set No.

3.

Accordingly,.while the Applicants continue to press their motion in order to preserve their claim to-its allowance, they will not burden the Board with reiteration of the reasons why CASE should be required to answer the interrogatories.
