PROPOSED JOINT BRIEFING SCHEDULE ON REALISM ISSUES  :

PURSUANT TO THE BOARD'S OCTOBER 30.1987 ORDER  !

Pursuant to the Board's Order of October 30, the parties report agreement on the i following proposed schedule for remaining briefing concerning treatment of issues 'I arising in connection with: the CLI-86-13 remand-proceeding and the Commission's October 29,1987, rule. (The parties' initial briefs on CLI-86-13 were filed on October 30, 1987.)

1. The parties agree on the following schedule for further submissions.

i November 17. 1987: Each party may file a brief addressing the  :

effect of the Commission's October 29, 1987 rule on the CLI-86-13 i remand proceeding.

November 24. 1987: Each party may file a brief re. plying to the views expressed in the briefs filed by the other parties on October 30 and November 17,

2. The November 17 filings of each party are to be served by hand or ,

telecopier on the other parties (as well as filed with the Board) by the close of business on November 17.

3. The parties agree that none of them has waived any rights it may have to seek an extension of time to file its November 24 reply for good cause, to be shown on 1

the basis of the other parties' November 17 filings.

4. One effect of the properal outilned above would be to eliminate the need for a separate set of briefs on November 9 since all replies would be consolidated in the November 24 filings. The parties recognize this may implicitly modify the Board's orig-i inal directive that responses to the issues raised by the October 30 briefs be filed on November 9. To the extent that the proposal implies such a modification, the parties request the Board to grant it.

Counsel for LILCO is authorized to represent that counsel for the NRC Staff and for Interveners Suffolk County, the State of New York and the Town of Southampton subscribe to the proposal described above and request that the Board grant it in time to eliminate any uncertainty about its desire for filings on November 9.
