NRC STAFF'S RESPONSE TO MOTION OF ATTORNEY GENERAL JAMES M. SHANNON TO AMEND THE HEARING SCHEDULE, AND REQUEST FOR CLARIFICATION On July 17, 1987, the' Massachusetts Attorney General filed a motion seeking to amend the hearing schedule to permit observance of the Jewish holiday of Yom Kippur. by the three attorneys in his office who have filed notices of appearance in. this proceeding. O The NRC Staff does not oppose the Attorney, General's Motion,
but notes that the Motion erroneously requests that hearings be recessed commencing on the
' afternoon of October 1,1987 (Motion at 1).
As is subsequently stated in the Motion, Yom Kippur actually commences on the afternoon of Friday, October 2 (Id., at'2); accordingly, any recess for the ho!! day should commence on the afternoon of Friday, October 2,1987, preferably at 2:00 p.m.,. In order to permit individuals who will be observing Yom Kippur sufficient time to return home and prepare for the holiday.

.Further, the Staff notes that Columbus Day (Monday, October 12),
- and Veterans Day (Wednesday,. November 11), fall on days for which hearings : have been scheduled.
inasmuch as Federal employees (and probably ' various other persons, as' well) are not required to work on Federal holidays, it may be' difficult to require the attendance of certain witnesses or other attendees on those days. Accordingly, the Staff seeks clarification from the Board that hearings will not be held on those dates.
Respectfully submitted, f
