l This provides notice pursuant to 10 C.F.R. 2.704(b) of my decision l
to withdraw as the Chairman of the Atomic Safety and Licensing Board hearing emergency planning issues in Long Island Lighting Com)any (Shoreham Nuclear Power Station, Unit 1) because of personal 1ealth considerations.
I have served as Chairman for almost three years in what is readily recognized as a most important, complex and difficult proceeding. The case will begin a new phase of litigatfon which will be intensive and extensive considering past performance. The record on emergency j
planning is c1 ready in the tens of thousands of pages.
J As this juncture, professional responsibility requires a renewed 1
comitment from me as Chairman, tc do whatever is necessary to meet the l
demands of this litigation. This comitment must be made without qualification. Personal considerations are not exempt. To do justice to the case requires no less.
I cannot again make that comitment in what is an arduous and long on going proceeding. When I accepted the Chairmanship, I had already I
undergone quadruple' coronary artery bypass surgery.
It was not expected that the proceeding would continue as long as it has.
Adverse developments this year in my cardio-vascular condition have increased concern for my health. Because of the situation at this time, I cannot again make the unqualified comitment necessary to continue to chair the proceeding.
I, therefore, withdraw from the Board.
