Docket No. 70-7002 Compliance Plan Closure Review

Dear Mr. Hiland:

In Inspection Report 70-7002/98-204, the Nuclear Regulatory Commission (NRC) identified an unresolved item concerning the adequacy of the closure of PORTS Compliance Plan (CP) Issues 8,9, and 23, and whether these findings may relate to a more generic issue concerning other CP items.

As a result of this finding, NRC had planned to perform a follow-up inspection at PORTS the week of July 6-10,1998. As discussed between you and Dave Waters of USEC, NRC delayed their inspection based on USEC accelerating our ongoing review of the closure of CP actions and issues.

' Additionally, NRC requested that USEC submit to NRC a summary of our review plan to determine the adequacy of the closure of CP issues and associated actions. The following information provides the requested summary.

'Ihe objectives of the investigation into closure of PORTS CP issues and actions are to ensure that:

- (1) action closure evidence is adequate; (2) implementation in the field is complete; and (3) the completed actions resolve the associated noncompliance described in the CP issue statement.

Accuracy of completion of CP actions will be determined by a review of a sample of closed actions from selected CP issues. The 15 CP issues to be sampled were chosen primarily by their impact on safety of the facility and then by whether they had received an independent review by DOE prior to transfer (those not reviewed by DOE were more likely to be chosen). From those 15 issues a " smart" sample of47 of the 132 associated actions were selected. Credit was given for 13 actions recently reviewed within those issues so that the total of remaining actions to review is 34. The " smart" sample included at least one action from each issue and ensured that the chosen actions were either l

GDP-98-2032, Page 2 representative of remaining actions or were a " downstream" action (i.e., an action which resulted from completion of other actions such as training which resulted from identification of training needs). The sample size of 47 from the population of 132 actions would statistically indicate, providing all 47 are found to be adequate, that there is 95 percent confidence ofless than 5 percent failures in the remaining population.

The above review is currently underway and is scheduled to be completed by July 24,1998. The scope and duration of this review may be increased if additional deficiencies in the closure of CP issues and actions are discovered. Deficiencies and program improvement suggestions will be

documented by a Problem Report and entered into the Corrective Action Program. A final report

- will be prepared which describes the results and findings during the investigation of the 47 actions.
