Dear Mr. Hutchinson:

By Entergy Operations, Inc.'s (EOl's) application dated December 12,1997, and the affidavit dated December 4,1997, executed by James H. Taylor on behalf of the B&W Utility Owners Group (B&WOG), and submitted by EOl's letter dated May 12,1998, EOl submitted Revision 1 of BAW-10226P, "Altemate Repair Criteria for Volumetric Outer Diameter Intergranular Attack in the Tubesheets of Once Through Steam Generators," December 1997, and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790. A nonproprietary version of the report was provided by EOl's letter dated January 29,1998.

The B&WOG stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

(1)

The information reveals data or material conceming the B&WOG research or development plans or programs of present or potential economic advantage to the B&WOG.

(2)

The use of the information by a non-member would decrease his expenditures, in time or resources, in designing, producing, or marketing a similar product.

(3)

The information consists of test data or other similar data conceming a process, method or component, the application of which results in an economic advantage i

to the B&WOG.

We have reviewed the application and the material in accordance with the requirements of l

l 10 CFR 2.790 and, on the basis of the statements by the B&WOG, have determined that the submitted information sought to be withheld contains proprietary commercialinformation.

l Therefore, the version of the submitted information marked as proprietary will be withheld from l

public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended, s

directly concemed to inspect the documents. if the need arises, we may send copies of this 1

- information to our consultants working in this area. We will, of course, ensure that the j

consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request i

includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
