Dear Ms. Davis:
This is in response to your letter dated September 24 1983 requesting
. infonnation on the Nuclear Regulatory Connission (NRC} requirements for States entering into low-level waste compacts. The Low-Level Waste-Policy Act of 1980 (LLWPA) (enclosed) did not give the NRC any.
authority to require States to develop a
- plan for either above or below ground disposal of low-level radioactive waste.
i Under Section 4 of LLWPA, the policy of the Federal government is that I
a) each State is responsible for providing for. the availability of.
capacity either within or outside the State for the disposal of low-level radioactive waste generated within its border and b) low-level radioactive can be most safely and efficiently managed on a regional basis.
The LLWPA dd define disposal as the isolation of low-level. radioactive waste pursuant to requirements established by NRC under' applicable laws.
This definition does not distinguish between above.or below ground disposal. An application for a facility,.that permanently isolates the radioactive waste from man and his accessible environment, with no expectation'of retrieval, would be handled as an application for disposal by NRC or Agreement States.
