SUBJECT:

NRC INTEGRATED INSPECTION 50-333/98-02 AND NOTICE OF VIOLATION

Dear Mr. Colomb:

On May 31,1998, the NRC completed an inspection at your FitzPatrick Power Plant. The

enclosed report presents the results of that inspection.

During the 6-week period covered by this inspection period, performance at the James A.

,

- FitzPatrick reactor facility was mixed. We are concerned with several inadequacies in the

administration of the licensed operator requalification training program. These

inadequacies reduced your ability to identify potential operator performance issues and

i

. training needs during requalification examinations, and were identified as three violations of

10 CFR 50.54(i-1) and 55.59. Also, the operators failed to adhere to requirements for

' implementing emergency operating procedures during the May 1,1998 manual reactor

{

scram. This failure was a concern because of a prior similar occurrence in September

.

1996, and was identified as a violation of technical specification 6.8(A)2.

Three other violations were identified during this inspection period. Two violations concern

inadequate procedures, as required by technical specification 6.8(A)2.; The third violation

I

concerns a self-disclosing transportation event on March 17,1998, when a radioactive

material shipment exceeded package radiation limits.

These violations are cited in the enclosed Notice of Violation, and the circumstances

surrounding the violations are described in detail in the enclosed report. Please note that

you are required to respond to this letter and should follow the instructions speeMied in the

enclosed Notice when preparing your response. The NRC will use your response, in part,

to determine whether further enforcement actions is necessary to ensure compliance with

regulatory requirements.
