Before I ask the Secretary to lead us 7
through the item, do any of my fellow Commissioners have any 8
remarks they'd like to make?

Mr. Chairman, the subject today is SECY 12 87-217, the OGC analysis of the review of ALAB-832, and we will 13 ask you to addrecs three issues in this order.
14 The three issues are the Licensing Board's refusal.to l
1 15 permit evidentiary hearing on whether the Shoreham plume i
16 exposure pathway emergency planning zone should be expanded to l
17 provide an adequate base for ad hoc emergency response efforts I
18 beyond the EPZ in very severe accidents.
It is Contention i

20 The second is the Board's refusal to permit an I
21 evidentiary hearing on whether the EPZ should be expanded by a l
22 few miles to minimize the occurrence and effects of spontaneous j

23 evacuation from outside the EPZ. Contention 22(c).

6 circumstances at Shoreham that were not envisioned in the I

emergency planning rulemaking and that would make it 8
inappropriate to apply to Shoreham the generic decision that an 9
EPZ of about ten miles is adequate for emergency planning

10 purposes.
b 11 Secondly, the order uphold the appeal board decision j
8 12 in 832 that the proceeding must be remanded to correct an error j
13 regarding the need for evacuation plans for hospitals in the i
14 EPZ.
