Dear Mr. Cevasco:
I am responding to your letter of May 29,1998, to Dr. Shirley Jackson of the U.S. Nuclear Regulatory Commission (NRC) in support of the request of April 9,1998, from the New England Coalition on Nuclear Pollution, Inc. We have determined that the April 9 request should be considered as a Petition pursuant to Section 2.206 of Title 10 of the Code of Federal Regulations (10 CFR 2.206) ' The Petition requests that we issue an order requiring that the
' licensee's administrative limits, which preclude Vermont Yankee Nuclear Power Station from operating with a torus water temperature above 80 F or with a service water injection temperature greater than 50 F, shall remain in force until certain conditions are met. The conditions listed include a complete reconstitution of the licensing basis for the maximum torus water temperature,' submittal to the NRC of a technical specification amendment request O
establishing the correct maximum torus water temperature, and completion of NRC's review of:
the amendment request.
1We have addressed the New England Coalition on Nuclear Pollution's request for immediate action at Vermont Yankee station by letter dated May 13,1998, and have enclosed a copy for your information. I have also enclosed a pamphlet on the public petition process. As provided by 10 CFR 2.206, final action will be taken on the New England Coalition on Nuclear Pollution's request within a reasonable period. ' We will send you a copy of our final decision on this as soon as it is issued.
