REVIEW OF REVISION TO SUPPLEMENTAL STANDARDS APPLICATION FOR OUlKRETE CONCRETE PLANT, VICINITY PROPERTY GJ-05107-CS

Dear Mr. Tucker:

By letter dated February 11,1997, the Department of Energy (DOE) requested Nuclear Regulatory Commission (NRC) approval of the Radiologic and Engineering Assessment (REA) for vicinity property GJ-05107-CS at 24621/2, Highway 6 and 50 in Grand Junction, Colorado.

The REA proposed utilization of supplemental standards for residual radioactive material (RRM) commingled with Resource Conservation and Recovery Act (RCRA) listed hazardous wastes.

DOE indicated that a disposal site does not exist that will accept RCRA-listed wasts commingled with RRM, and that treatment of material to removed the hazardous waste is not always successful. In addition, DOE does not have authority to manage the waste under the Uranium Mill Tailings Radiation Control Act. The area where the RRM was proposed to be left in place is an unpaved access road into the plant site. After review of the REA, the NRC staff concurred, by letter of April 11,1997, with DOE'S recommended Alternative 2, removal of the top 3 feet of RRM and application of supplemental standards (no remediation) for the remainder of the deposit, because the cost of managing the commingled waste is excessive in comparison

By letter of April 22,1998, DOE informed NRC that, in the process of remediation of the subject site, chemical odors and discolored soil were encountered at a depth of about 2 feet. Soil analysis indicated the presence of RCRA-listed waste and the excavation was backfilled without removal of the planned volume _ DOE considers that gamma radiation levels have been ld reduced to acceptable levels, that the approved supplemental standards application has be*n g[j ]

The added footnote revision to Section C.S.2.4 of the original supplemental standards application indicates that the additional matedal to be left in place is addressed under the approved application of supplemental standards.
