Dear Mr. Dawson:
As you know, Mr. G. Wayne Kerr, Chief, Agreements and Exports Branch has been serving as the NRC representative on the Kentucky Environmental Study Design Consmittee which the State established in February 1975.
Subsequent to that, Governor Carroll requested NRC to make an independent review of the situation at the Maxey Flats, Kentucky, commercial waste burial site.
A report of our independent review was sent to Governor Carroll and to you on July 14, 1975. Since Mr. Kerr has served as.a member of the independent review group and has a continuing responsibility to review the State's total radiation control ~ program conducted pursuant to a Kentucky-NRC agree-ment under Section 274 of the' Atomic Energy Act of 1954, as amended, we believe that he can no longer be an active participant in the work cf the Environmental Study Committee. We will, of. course, continue to provide technical assistance to the State in accordance with our long standing practice and would like to.have Mr. Kerr continue to serve as an observer
