i Note to Don Nussbaumer
,l Mr. C. Eason, Washington representative for NECO called me on April 21, 1975. He stated that Bobby Wilson, former employee of the Kentucky radiological' health program had testified at a hearing held by the Chairman, Kentucky Environmental Quality Commission.
I understand his testimony was similar to infor-mation he had formerly sent to the Governor in writing.
Wilson alleged that the Kentucky Radiological Health Program (Chuck Hardin's group) had not properly enforced regulatory requirements at the NECO Maxey Flats commercial waste burial facility. He recommended an independent investigation of the State's radiation control program and the conditions at the burial site.
Eason stated that the State inspected the site over the last weekend and found no problems.
He stated that an article appeared in the Louisville paper on (4/17), an editorial in the same paper on 4/20 and a feature story would be run on 4/27.
Hardin was invited but did not attend. [ b,w.s j,Q 6 u~u +.h 6 M 'M ]1 He stated that NECO was not invited to the hearing and that s
a Eason stated that NECO may suggest that NRC conduct an independent investigation of the whole matter.
It is,my impression that NECO is afraid that EPA may be asked to do the independent investigation and they want to head that off.
Hardin informed me that they prepared a position paper for the Governor reiterating they do not feel the site should be shut down l
i for health and safety reasons and based on one person's general i
allegations.
He stated that Wilson inferred the forthcoming GA0 l
report on waste disposal may adversely reflect on several of the

commercial sites.

, Note to A. F. Perge NECO MOREHEAD, KENTUCKY (MAXEY FLATS) BURIAL GROUND s
On April 29, 1975, Dr. Pittman's office referred to me a call from a Dr. Gene Plock of the University of Louisville. Dr. Plock stated that the NECO Morehead, Kentucky, commercial burial ground had been receiving some heavy adverse publicity in the Louisville papers regard-ing " releases of radioactivity" and " migration of radioactivity from the burial ground." The stories were, in part, based on stories or statements from ex-NECO employees and an ex-member of the Kentucky Department of Human Resources, the regulatory group responsibic for regulation of the NECO site.
l Dr. Plock and a Dr. Conner of the University had been asked to do sorue followup work by a Dr. Acres, the Secretary of the Development Cabinet of the Commonwealth of Kentucky. Apparently Dr. Acres is acting on behalf of the Governor's office.
Dr. Plock is going to forward copies of some of the newspaper arritles, and said some of them had statements like " radioactive liquids had intentionally been dumped out on the ground" and "there have been measurements of dangerous amounts of activity in sampling wells off the Maxey Flats sitc."
Also, that the paper (s) ran a photograph showing waste in a trench that was partly filled with water.
I spent some time on the telephone with Dr. Plock giving him as com-plete a story as I could, including comments such as (1) NECO and Kentucky personnel have,*in my opinion, been making an honest and concerted effort to correct any deficiencies that have existed in operational methods, (2) any complaints on operating methods (con-taminated water released on the ground) would probably have been based on experience of more than 2 or 3 years ago, (3) while there is a report showing positiye levels of activity at sampling points outside the plant boundary, the levels are very low and certainly do not constitute a health hazard. Also, that Kentucky is proposing an extensive study program to determine what real problem, if any, they have because of their responsibility as owner and long-term co'ntroller of the site, (4) rainwater can be expected in the trenches because of the high rainfall and low permeability of the soil, but that positive efforts are being take to (a) separate uncovered waste from water in the yet-unusual space in a trench, (b) completed trenches which contain water are being routinely pumped down and the water properly control-led and treated, (c) there is a routine program of trying to keep trenches " scaled," 1.c., make the cover as impermeable as the undis-turbed soil, (5) regarding his reference to problems at the NFS West Valley, New York, site; that it seems to be the same type problem 1

as at the NECO site and at the }iNL, i.e., high rainfall and relatively
', impermeable, undisturbed soil results in a syst.em which can end up j
with contaminated water " overflowing" a trench if proper sealing and/or water managenent is not practiced, and (6) the past and cur-rent Federal versus Kentucky responsibilities at the site, including that the NRC does have some sort of responsibility to assure them-selves that Agreement State programs are operated in a way that does not " endanger the health and safety of the general public."
Dr. Plock was looking for " independent" and "obj ective" input or com-ments.
(Dr. Plock knows my main contacts in the Kentucky Department of Human Resources - Charles Hardin and Richard Fry - but apparently wants input from others.)
I suggested that he may also want to con-tact George DeBuchananne of USGS (in addition to NRC) since USGS is planning on doing considerable study work at Maxey Flats.. I also pointed out to Dr. Plock that my responsibilities include the ERDA land burial sites and that in my personal opinion land burial is an acceptable disposal technique for some categories of solid radioactive wastes (with proper selection of the disposal sites) - I could not therefore claim to be " objective" about the subject, but would be glad to provide additional input if he had further questions.

Kentucky has one of six commercial radioactive waste disposal sites in i the United States. The regulatory responsibility for this site lies i within this Department. This regulatory responsibility is under the . agreement which the Commonwealth of Kentucky made with the Nuclear Regulatory Commission (AEC) in 1962. In the early investigations of the geology of the area in which this site is located, the geological findings indicated that the migration of radio-activity from this site would be very remote. However, recent data obtained from our environmental monitoring network indicates radioactivity in the environment in the immediate vicinity of this site. Although this data is positive indication that the disposal site is contributing radioactivity to the environment, our environmental program is not designed to indicate the mode by which such radioactivity is moving. There are currently four modes by which this radioactivity could be moving from the site to the environment. 'lhese modes are: 1. Surface water run-off 2. Atmospheric fallout from the evaporator plume 3. Migration through geologic fonnation fissure systems 4. Lateral migration through the weathere'd zone Our environmental monitoring network is designed to detect the early movement of radioactivity from this site. Since this monitoring network has positively identified radioactivity in the environment, there is an immediate need to re-evaluate this site for its continued use for the burial of radioactive materials and to assess the long range public health significance of the radioactivity now detected in the environment. This Department has received the recommendations from a specially called advisory committee on the type studies which are needed to evaluate this site for making the determinations of its future use and long range public I E \\

This Department intends to implement the studies recommended by this committee. As shown in their recommendations, the total cost of this study is' great. This Department feels that the future of this site will have impact on the future of other commercial radioactive waste sites which ultimately will have impact on the total nuclear industry. In light of this impact on.the total nuclear industry, we feel that the study of this site is crucial to the interest and objectives of the Energy Research and Development Administration. Not only will the information obtained from this recommended study have poten-tial impact on present commercial sites but the information gained may provide for the establishment of criteria that can be used for the siting and design of future sites for the disposal of radioactive waste. Since the outcome of this study appears to be in the interest of the Energy I Research and Development Administration, I am requesting that your Agency l assist this Department both technically and financially in the conduct of j this study.
