Dear Chuck:

I have reviewed the writeup forwarded with your April 4, 1975, memo-randum regarding the February meeting of the " Department for Human Resources Radioactive Waste Disposal Environmental Study Design Com-mittee."

You seem to have pulled together a good writeup from the very wide-ranging discussions that went on.

Although there was not complete unanimity on all points, I believe you have identified the traximum program the group considered feasible at the Maxey Flats site.

I would, however, like to make one further suggestion on the priority order and timing of the studies. On further reflection, it.seems

,to me it would be quite useful'to pinpoint the impact of past sur-face runoff problems before making a full commitment to some of the other long-range studies. Of course, to be useful, this means near-term efforts would need to be concentrated on the surface runoff question and the time for some final answers must be much less than

, the three years listed in your writeup.

I feel there could be con-siderable payoff from this approach - if, indeed, surface runoff contributed to positive environmental samples and early results of the Mantle Zone and Hydrogeologic studies indicate that little true underground migration was occurring, less long-term effort might be justified in some of the studies, particularly those on Hydrogeologic, Agricultural Pathway and Environmental Biological Pathway.

g This is in reference to your request for comments on your summary of the recommendations of the Environmental Study Design Committee for the Maxey Flats radioactive waste disposal facilit'.

y First of all it is my clear impression that the' Committee did not consider.the migration, if any, at Maxey' Flats to be a health hazard.

This should be emphasized at the outset.

It is also my impression that the Committee was not sympathetic to the expenditure of $1,000,000 plus to carry out what might l>e described as esoteric research.

Accordingly it is extremely mis-leading to have the Report so structured that seven of the key sentences lead off with.the phrase'"Information is needed.

What the Committee was saying was, that if you are really i

interested in conducting such a study, it would be desirable to consider the follo. wing information etc., etc.

At no time did it recommend that the research be done.

I am also somewhat disturbed that you would contemplate going i

to the Secretary with a Report which would leave the impression that a $1,000,000 study is needed to assure the health and safety of the citizens o'f the Commonwealth of Kentucky.

In fact it may be that certain aspects of.this study would add to the potential hazard at

-the site because drilling additional observation holes could create additional pathways for potential migration.

I fully appreciate your concern for what you believe is your responsibility to the general public.

But I am of the definite opinion that the " hazards" at Maxey Flats have been blown out of all proportion.

As the operator of the Morehead facility NECO has

It is in this light that'

I urge the' Repor.t be modified to more accurately reflect the views of.the Committee to assure that the Executive and Legislative branches of the Commonwealth, the news, media and others are not' misled.

For the reasons above stated I cannot endorse the Report in its

.present form.
