This letter is to confirm the telephone agreement of June 12,1998, between you and Dennis Serig of my statf that you will assist the Nuclear Regulatory Commission (NRC)

Division of Industrial and Medical Nuclear Safety as a subject matter expert with respect to radiation therapy systems regulated under Part 35 of Title 10 of the Code of Federal Regulations. An NRC contractor, Scientech, Inc., will contact you concerning a risk assessment that they are performing on systems using nuclear byproduct material. Scientech is expected to ask you about normal conduct of various approaches to radiation therapy (e.g.,

teletherapy, various approaches to brachytherapy). The information you provide will make a major contribution to Scientech's ability to perform a realistic risk assessment.

Please note the information in Enclosure 1 regarding consultant liability and service with other Federal departments or agencies. Please notify Dennis Serig (contact information provided below) if you are currently performing work for other Federal departments or agencies.

Enclosure 2, is a blank voucher for professional services (NRC Form 148) for your use in claiming reimbursement based on the time you spend in responding to Scientech. Enclosure 3 is a blank claim for reimbursement for expenditures on official business (SF 1164) for your use in claiming reimbursement of telephone, facsimile, or related expenses that you incur in responding to Scientech. Please submit claims for reimbursement to:

O Enclosure 1 RESTRICTIONS ON SERVICE WITH OTHER FEDERAL DEPARTMENTS OR AGENCIES U.S. Nuclear Regulatory Commission policies and procedures for obtaining the services of consultants are defined in a Commission Directive '. The following information is contained in the Directive and has direct implications for the physician and scientific consultant.

Service with Other Aaencies An employee who serves two or more Federal Departments or agencies is required to inform each of his or her arrangement (s) with the other. If the individual's appointments are made on the same date, the aggregate of the estimates of the days of services will determine the decision, by each gency, as to whether the individual is " Regular" or "Special." If, after being employed by one department or agency, a Special Govemment Employee is appointed by another agency, the second agency must make an estimate of the individual's days of service for the remaining portion of the 365-day period which was initiated by the first appointment. The sum of the estimate and of the actu.al number of days of service to other departments or agencies, during the prior portion of such 365-day period, will determine whether the individual is " Regular" or "Special."

Close coordination between the agencies and the appointee must be maintained to insure that the 130-day limitation is not inadvertently exceeded.
