Gentlemen:

This letter supplements Bonton ' Edison'Il Sep, ember 26, 1967
{
letter, which responded to the ' matters addre# sed, in Inspection Report 8Q30, the September 9,
1987 Enforcement Conference, and l
the SepteaQr 30, \\To 1987 Management Meeting.
Based, upon the recently issued / revisions the " Policy and Procedur9 for Enforcement ActigtM" (52 Fed. Reg. 36215 (September 25, 1987)), Boston Edison sub: nits that additional reasons now exist for NRC to refrain from taki'ng further enforcement action-for the alleged airlock' door
{
vioD4 tion identified in Inspection Report 87-30.
4 D.i ;harticular, the alleged airlock door - violation falls squarely ylthin the 'counds 3 of the four criteria (Munciated in the above-men'tioned NRC enforcement policy revisions.
Boston Edison e
has already been " forced into an extended shutdow has developed aM is aggressively implementing. L. h... ;...

concurrence is needed by the licensee prior to restart.S See Criterion V.G.2.a.
Although NRC identified the alleged violation, as shown in Boston Edison's September 26, 1987 letter, further enforcement action is not "necessary to achieve remedial action."
/
See Criterior L G.2.b.
Since the condition ot' the airlock door that 'resulted in' sthe violation existed since 1979, the alleged i viciation is " based upon activities of the licensee prior to the evonts leading to the shutdown."
See Criterion 7.G.2.c.

alleged violation is non-willful' and cannot be " categorized higher than Ia) a Severity. Level III" violation.
.See Criterion.V.G.2.d.
1 Accordingly, under the revised ~NRC enforcement policy, NRC should refrain from issuing a Notice of Violation or taking escalated enforcement action in regard to the airlock' door.
Based upon - the ' foregoing, Boston Edison requests that NRC consider this supplemental response and refrain from taking further enforcement action in regard to. Inspection Report 87-30.
