Comments of Commissioner Dicus on SECY-98-113 1 agree with staff that th'e extension of the requirements of 10 CFR Part 72 to holders of, and applicants for, certificates of compliance, and their contractors and subcontractors would make clear the Commission's intention that the standards in this area are enforceable requirements. Accordingly, I approve publication of the proposed rule for comment.- The regulatory issues in this matter are newly emerging and, in some significant respects, are unique. If the proposed rule is finalized, the expansion of the enforceability of the requirements of 10 CFR Part 72 should be' viewed only as an intention to provide staff a more complete set of regulatory tools to deal with the issues.
Given the special nature of the regulatory issues, staff should be flexible in dealing with
' them and resort to enforcement only when other regulatory tools have not resulted in their resolution.
