BYRON INSPECTION REPORT 50-454/98011(DRP); 50-455/98011(DRP)_

AND NOTICE OF VIOLATION

Dear Mr. Kingsley:

On May 30,1998, the NRC completed an inspection at the Byron 1 and 2 reactor facilities. The

enclosed report presents the results of that inspection.

During the inspection period, we found that your evaluation of shutdown risk for planned activities

was thorough. We also noted that control room activities were consistently performed in a .

professional manner, in addition, we observed effective heightened level of awareness briefings,

strong reactivity management, and effective oversight by operations department management

and Quality and Safety Assessment personnel of infrequently performed . evolutions.

. However, we are concemed with the recurring problems in the implementation of the

out-of-service program. Since September 1997, you have repeatedly identified out-of-service

errors. We are concemed that to date, your corrective actions have not been effective to prevent

reoccurrence, as demonstrated by the out-of-service errors during the recently completed Unit 2

- refueling outage. These recent errors represent the failure of multiple barriers in the -

out-of-service program and ultimately placed personnel and equipment at risk.

In addition, we are concemed with the multiple examples of your failure to follow station

procedures. The most notable examples involved the failure to implement your ventilation barrier

- impairment process which, when combined with the failure to follow a maintenance procedure,

resulted in the facility being in a condition prohibited by Technical Specifications and outside the

ventilation design basis. Consequently, had an accident occurred while the ventilation system

was outside the design basis, the offsite dose and control room habitability dose would have

been increased.

Based'on the results of this inspection, five violations of NRC requirements were identified. The

i

first ' violation involves a deficiency in the implementation of the out-of-service program. Although

the example was self-disclosing, a violation is being cited because this is a repetitive issue. The

second violation pertains to the failure to follow an operating procedure due to poor

communications practices. Although this violation was also self-disclosing, a violation is

being cited since you had not developed and committed to corrective actions prior to the end of

the inspection period. The third violation relates to four examples of your failure to implement the

ventilation barrier impairment process. The fourth violation involves the failure to follow a

maintenance procedure regarding the control of penetration sleeves on the refueling water

!

storage tank pipe tunnel temporary hatch cover. The fifth violation pertains to your failure to

- update the Final Safety Analysis Report to include the effects of a safety evaluation in support of

a conclusion that the change did not involve an unreviewed safety question.

' These violations are cited in the enclosed Notice of Violation (Notice), and the circumstr.nces

surrounding the violations are described in detail in the enclosed report. Please note that you are

required to respond to this letter and should follow the instructions specified in the enclosed

Notice when preparing your response. The NRC will use your response, in part, to determina

whether further enforcement action is necessary to ensure compliance with regulatory

requirements.
