COMPLETION OF ACTIONS RELATED TO CONFIRMATORY ORDER MODIFYING LICENSE
Dear Mr. Murakami:
This refers to the "Second Transportation Audit Report" transmitted to the NRC Region IV office with your May 28,1998, letter. This audit was the second of two transportation audits required pursuant to the Confirmatory Order Modifying License (Order) issued to NDC Systems (NDC) on January 13,1997.
We have reviewed the audit report prepared by your consultant, Mr. Alfred W. Grella (Auditor), and the comments in your letter in response to the audit findings. The cudit results indicated that NDC has made significant progress toward achieving greater management attention and oversight of transportation activities to ensure compliance with Department of Transportation (DOT) requirements. The report also noted that NLiC management had affectively responded to previous NRC concerns raised in the Order regarding employee awareness and training for reporting safety concerns. In addition, the auditor concluded that NDC had implemented essentially all of the recommended actions from the first transportation audit, performed on January 20,1997. These actions included developing written guidance and procedures for certain items that had not been previously addressed by NDC and were identified as deficient during the last NRC inspection in December 1997. .
We note from your letter that NDC has agreed with all of the second audit report findings and recommendations except for two apparently minor items regarding the need for DOT training of a NDC receiving supervisor, and the recording of certain package vibration test information. You further indicated that these two items are currently under discussion with the auditor for resolution.
Therefore, based on our review of the two consultant's audit reports and NDC's corrective actions as documented in the reports and as confirmed during the last NRC inspection, NDC appears to have complied with all conditions of the Order which is now considered closed.
We will review the continued implementation of your corrective actions during a future ;0/

inspection to determine that full compliance with DOT shipping requirements has been achieved and will be maintained.
