The Commission

  • discussed the circumstances surrounding the-March 27, 1987, import by Edlow International Company of South: ,

African origin natural uranium. The legal basis for possible  !

NRC enforcemen't action against the licensee and for prohibiting-processing of the imported material was discussed. The Com-mission also discussed the future policy of the NRC regarding import of material from South Africa.

By a vote of 4-0, the Commission ,

(a) agreed that, based on advice from the General Counsel's office, the Commission has no legal basis to bar further processing of the natural uranium imported by Edlow-International Co. for subsequent re-export to Spain since c {

the NRC failed to amend the licenses to prohibit such B  :

imports. Commissioner Asselstine would amend.the existing @

licenses to conform with the OGC interpretation of Sec. W5 309 of the Anti-Apartheid'Act of 1986 that imports of 2Ef 4

uranium ore and oxide of South African origin would be barred in the future.
