The Comission's Office of the General Counsel, witL ta assistance of the NRC staff, is in the process of pr.eparing an options papers for the Comission. The paper will include a consideration of the many thousands of coments which were received. The Commission intends to receive a briefing on the paper when it is in final form. That brieffng will be held in open session, and , copies of the paper will be available to the public. The staff briefing of the Comission on the proposed rule is tentatively scheduled for 10:00 a.m. I on October 22, 1987. l The focus of this briefing will be on any proposed modifications and/or

As members of Congress concerned about energy and public safety, we are writing to urge that you consider the proposed regulation concerning off-site emergency response planning for nuclear power plants in the most open and public manner. As you well know, the emergency planning rule has been the cubject of intense public debate and scrutiny since it was first proposed -- in the news media, in public meetings, and in the Congress. Thousands of citizer.1 and public officials have commented to your agency on the proposed regulation. Now that the ccmment period has ended and the Commission is preparing to evaluate public responses to the proposal, we want to express our support for a continued open rulemaking process.

                     -Before the Commission prepares to promulgate the proposed emergency planning regulation, we urge that you convene a public hearing.            Given the unusual degree of public interest in this regulation, we feel that such a meeting would be useful for several purposes: to review public comments; to learn of any modifications to the rule under consideration by the NRC:-and to hear from members of the public about possible alternative courses of action.

Additionally, we urge that at such time as the Commissioners are ready to take final action on the proposed regulation, that any vote be taken in a public session. Thank you for your consideration of our request. Sincerely,
