LEGAL ACTION AGAINST TOLEDO EDISON COMPANY AND TWO CONTRACTORS Mark Vining, former quality control inspector for Bagvell Coatings Inc.,
a painting contractor at the Davis-Besse Nuclear Plant, has filed a lawsuit against Bagwell, Toledo Edison Company, and Bechtel Company alleging conspiracy in his discharge.
Mr. Vining was discharged in 1974 and subsequently alleged to the NRC Region III Office that there were quality assurance violations in safety-related painting work at the plant and that the paint application on the containment vessel was inadequate. A subsequent investigation by Region III confirmed his I
allegations. Toledo Edison Company and its contractors have extensively 1
tested the paint and removed several sections of paint judged to be I
inadequate. Their remedial action has been appropriate.
i Mr. Vining's suit alleges that the plaintiffs failed to meet regulatory standards guaranteeing his independence in quality assurance responsi-i bilities.
The lawsuit was filed November 5, 1976. The discovery process has begun with Mr. Vining's attorney seeking various documents from the j
defendants, including some NRC documents and minutes of meetings l
between the plaintiffs and the NRC.
I There has been no publicity on the suit.
Region III received notification of this occurrence by telephone from t
a Vice President of Toledo Edison Company at 4:40 p.m., December 7,1976.
