] NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Philadelphia Electric Company (EA 87-88) ,

(Peach Bottom Atomic Power Station Units 2 and 3) l 50-277 and 50-278 Docket Nos.

PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Fifty Thousand Dollars ($50,000) will be issued on or about July 29, 1987 to Philadelphia Electric Company.

This action is based on numerous examples of the failure to meet the fire protection requirements of 10 CFR Part 50, Appendix R. The violation involved failures to provide a neans for maintaining one redundant train of systems (su^ as emergency service water, residual heat removal, reactor water level and pressure indicators, and reactor core isolation cooling) necessary to achieve and maintain hot shutdown conditions free of fire damage

'in the event of a fire in certain areas of the plant. The escalation and mitigation factors in the Enforcement Policy were considered and no adjustments were deemed appropriate.

It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorized by tne Deputy Executive Director for Regional Operations to sign this action. The schedule of issuance and notification is:

Mailing of Notice July 29, 1987 Telephone Notification of Licensee July 29, 1987 A news release has been prepared and will be issued after the licensee receives the Notice. The State of Pennsylvania will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
