Dear Mr. Matthews:

This letter is in response to y(RRM), which may have been commingled with other j

our March -2, 1989 letter regarding the Title I residual radioactive material hazardous wastes, at Grand Junction, Colorado Vicinity Properties. You had requested that we meet in Denver, Colorado on March 23, 1989 to discuss this situation with the Colorado Department of Health. Based upon.our review of the situation, we concluded that a meeting at that time would be premature.

Giorgio Gnugnoli (HRC/NMSS) telephoned Deborah Mann of your staff on March 16, 1989 to cancel the meeting.

In their discussion Mr. Gnugnoli went into some detail regarding the regulatory complexities involved with the presence of mixed waste and, more significantly, of Polychlorinated Biphenals (PCBs) and Dioxins.

Based on our internal discussion with our legal staff, we have concluded that the Uranium Mill Tailings Radiation Control Act (UMTRCA) and the Atomic Energy Act (AEA) do not appear to provide the unique bases for covering the disposal of such commingled wastes.

It appears that a permit and/or exemption from the relevant EPA authority will be necessary.

I recommend that the DOE approach the EPA for assistance in the appropriate strategy for the disposition of this commingled material. After you have consulted with the EPA regarding this situation, we would have a clearer choice of options available for this type of cleanup.
