Dear Ms. Robinson:
Pursuant to the Freedom of Information Act, 5 U.S.C.
S 552, as implemented by 32 C.F.R.
Part 701, it is requested that this Company be provided copies of the following:
1.
All documents, including but not limited to correspondence, direction, agreements, contracts, reports, or shipping records, arising out of or relating to the collection, storage, pick up, management, handling, transportation, delivery, i
shipment or disposal of radioactive waste material from Newport News Shipbuilding and/or Nuclear Service and Construction Company facilities during the years 1962 through 1978.
2 All documents, including but not limited to I
correspondence, direction, agreements, contra. cts, reports, or studies concerning the ownership, design, development, construction, licensing, operation, and/or environmental impact of the Maxey Flat Nuclear Waste Disposal Site near Morehead, Kentucky.
As used in this request, the term, documents, includes writings, drawings, charts, tapes, computer readable material, photographs, and other data compilations from which information can be obtained, translated, or copied.
As you know, Section 552(b) of the Act provides that, if some parts of a file are exempt from release, " reasonable segregable" portions of the nonexempt material should be provided.
I request, therefore, that if you determine that any portion of the requested information is exempt, you provide me immediately with a copy of the nonexempt portion of the documents.
I reserve my right to appeal any and all such decisions.
If you determine that some or all of any document requestod herein is exempt from release, I would appreciate your advising me as to which exemption (s) you believe cover (s) the

Please separately state your reasons for not invoking your discretionary powers under the Act to release in the public interest any material you deem to be exempt.
Such statements will be helpful in deciding whether to appeal an adverse determination, and in formulating arguments in the event of any appeal.
