- Wilmington, North Carolina 28402 4 Gentlemen:

l The General Electric fuel Fabrication Plant at Wilmington, North Carolina has been identified by the International Atomic Energy Agency (IAEA) under Article 39(b) of the US/IAEA Safeguards Agreement for the application of IAEA safeguards. This will take precedence over your present participation in the IAEA program under Article 2(a) of the protocol to the Agreement.

This notification is the first of a two-part selection process arranged with the IAEA to enable the U.S. to implement IAEA safeguards at a selected facility within the 90-day period specified in the US/IAEA Agreement.

Title 10 CFR Part 75 will be utilized to effect the implementation of this program. Installation information of the type described in %75.11 should be l prepared on the enclosed IAEA Design Information Questionnaire (DIO) Forms i N-71 and N-73, or submitted as a revision to your existing DIQ depending on l the complexity of the update. Fifteen copies of the completed form are to be submitted to this office by August 28, 1987. Written instructions which provide guidance in the preparation of these forms have been included with this letter. Completion of the DIQ will also satisfy the requirements of 675.14. All information submitted by you in response to this request will be transmitted to the IAEA as provided in s75.12. ]

i Upon receipt of the second notification in writing from the NRC, which will be  ?

subsequent to DIQ preparation and review, an inventory report and subsequent i accounting reports are required by 75.32 and s75.33. This inventor l l to be submitted on DOE /NRC Forms 742, Material Balance Report and (MBR) 742C, y report is i Physical Inventory Listing (PIL). A separate form for each material type will 1 be prepared in accordance with printed instructions for completing the fom. l This MBR/PIL may be based on book values. The completed MBR/PIL should be j dispatched to the Commission within twenty (20) days after the specified j initial inventory reporting date contained in your second notice. i Utilizing the installation information provided under 675.11, the United States and the IAEA will negotiate a " Facility Attachment" for your facility which will detail how IAEA safeguards will be applied there. This will include periodic on-site inspections by IAEA personnel.

To the extent indicated in 575.8(e), you will be provided an opportunity to I participate in the preparation of the facility attachment. Appropriate i provisions of the Agreement and the " Facility Attachment" will be implemented j in your facility through the issuance of a license amendment or other l appropriate means. The anticipated time frame for the second notice is l January - February 1988.

With your cooperation, we will meet the U.S. obligations under the US/IAEA Safeguards Agreement as efficiently and smoothly as possible.
