Enclosed are 6 copies of Duke Proprietary Topical Report DPC-NE-2000, "DCHF-1 Correlation for Predicting Critical Heat Flux in Mixing Vane Grid Fuel Assemblies". This report doc'unents the development and verification of the DCHF-1 critical nea* flux correlation which is applicable to Westinghouse.15 X 15 and 17 X 17 (standard and optimized) fuel assemblies. Appendix C of this report supports the application of DCHF-1 to Babcock and Wilcox Mk BW Fuel which Babcock and Wilcox will be supplying to Duke as reload fuel for Catawba and McGuire Nuclear Stations. This report is submitted in order to obtain approval for using the DCHF-1 correlation to support licensing of fuel assemblies which utilize the mixing vane space grid design. Duke Power Company requests that this report be treated as proprietary. Attached to this letter is an affidavit to support the proprietary nature of portions of this report. I am Vice President, Design Engineering Department of Duke Power Company (" Duke") and as such have the responsibility of reviewing the proprietary information sought to be withheld from public l disclosure in connection with nuclear power plant licensing l cr rule-making proceedings, and am authorized to apply for its i withholding on behalf of Duke. 2. I am making this affidavit in conformance with the provisions of 10 CFR 92.790 of the regulations of the Nuclear Regulatory Commission ("NRC") and in conjunction with Duke's application for withholding which accompanies this affidavit. 3. I have knowledge of criteria used by Duke in designating information as proprietary or confidential. 4. Pursuant to the provisions of paragraph (b) (4) of 10 CFR 92.790, the following is furnished for consideration by the NRC in determining whether the information sought to be withheld from public disclosure should be withheld. (1) Tne information sought to be withheld from public disclosure is owned by Duke and has been held.in confidence by Duke and its consultants. (ii) The information is of a type that would customarily be held in confidence by Duke. The information consists an empirical correlation developed by Duke and its' consultants. (a) The use of the information by a competitor would greatly reduce its expenditure in qualifying similar correlations. (b) It reveals aspects of a correlation with potential commercial value to Duke Power. (iii) Appendix C of the subject information is proprietary to Babcock & Wilcox Company (B & W), Lynchburg, Virginia. B & W's July 1987 letter makes reference to their affidavit, concerning the proprietary nature of this data, which affidavit I itself is enclosed within B & W's May 21, 1986 letter, "BWCMV Topical Report". (iv) The information was transmitted to the NRC in confidence 1 and under the provisions of 10 CFR $2.790 ; it is to be received l in confidence by the NRC. ] (v) The information sought to be protected is not available in public sources to the best of our knowledge and belief. i (vi) The proprietary information sought to be withheld in this submittal is that which is marked in the proprietary version of the report OPC-NE-2000, DCHF-1 Correlation for Predicting Critical Heat Flux in Mixing Vane Grid Fuel Assemblies, September 1987, and omitted from the non-proprietary version. This information enables Duke to: (a) Respond to NRC requests for information regarding the thermal-hydraulic behavior of mixing vane fuel supplied by Westinghouse Electric Corp. and Babcock & Wilcox Co. contained within Westinghouse pressurized water reactors. (b) Support license amendment and Technical Specification revision requests for Westinghouse pressurized water reactors. (c) Perform safety reviews per 10 CFR 50.59. (vii) The proprietary information sought to be withheld from public disclosure has substantial commercial value to Duke. (c) Duke intends to provide engineering services for other utilities using this information, with exception of . Appendix C.
