ty We here at Ito-En (USA) Inc. accept the findings and determinations o7 the U.S. Nuclear Regulatory Commission as stated in the Notice of Violation. We do not wish to materially challenge its contents with the understanding that if any elevated action were being considered over and above the contents of the Notice of Violation it would have been in conjunction with this notice as per 10 CFR, Part 2, Appendix A.
The reason that these violations occured was that the appropriate rules, regulations and proceedures of the Title 10 CFR mailed by. Industrial Dynamics to Aloha Juice, in conjuntion with the purchase of the source by Aloha Juice, were not read or, if read, were not fully understood by Aloha Juice personel.
This omission was passed on to Ito-En when Ito-En purchased Aloha Juice and retained the Aloha Juice Management Group. (I would like to point out that the inspection report erroneously states that I, Charles T. White, was an Aloha Juice employee. I came aboard after Ito-En purchased Aloha Juice.)

due to the improper disposal of the unit. The logical course of action was

to attempt to locate the Filtec. When we were unable to 'ocate the unit we again turned to Industrial Dynamics for guidance since thry seemed aware of what the proper coarse of action was. Through-subsequent' conversations and l
research we' did what we felt was the most appropriate thing to do; we informed the Hawaii Department of Health, Noise and Radation Bre.nch of the units dis ~
posal. They.in turn contacted the NRC and that is when we started learning-properly of our obligations surrounding posessing such an item.
Once we clearly understood our responsibilities we fulfilled every request f
and proceedure within our capabilities. We cooperated fully with the NRC investigation and took the opportunity to gain a complete understanding of responsibilities surrounding ownership of such-a source.
l Our new Filtec Source is duly registered. A wipe test was conducted on'11/17/88 upon instillation, and the proper seals affixed. Mid-Pacific Medical Physics has been contracted to do a wipe test in April 1988 and at six month intervals-thereafter (Liscense # 53-23207-01). All levels of management have been made aware of the fact that we have a radioactive source on site and have been informed of the obligations that are associated with their responsibilities.
Our rank and file people have been told that this-equiptment'is dangerous and radioactive. They have further been instructed ~that repairs are to be.done only.by highly trained, expert and liscensed personelle ONLY. Furthermore, they are to report immediately any and all incidents involving the Filtec.
A file is kept and maintained on the unit. In that file are rules, regulations, correspondence, contacts and proceedures that'may be needed~to assure the proper and safe operation of the equiptment. In the event of any unforseen problem with the unit upper management as well as first line supervision have been instructed to call the Nuclear Regulatory Commission.
We would like to thank all those involved with this incident from your agency for their help, guidance and genuine concern in assisting us.
