On July 14 and July 16, 1987, Duquesne Light Company submitted on behalf of itself and Ohio Edison Company applications for approval of sale and leaseback transactions involving Beaver Valloy Power Station (BVPS)

Unit 2.

As part of the approval process we requested that the BVPS Unit 2 license be amended to reflect the conditions of approval.

The license currently in effect and referenced in the applications is low-power operating license, NPF-64.

We have assumed that a

condition incorporated into the low-power license will, as is the NRC

practice, be rolled into the full-power license when that

' license is issued.

It has come to our attention that the full-power license might be issued before the Staff is able to approve our application and, to the extent you deem it necessary, to amend our applications.

We l

respectfully request that the Staff amend the low-power license as requested in the applications if that license is still in effect at the expiration of the Federal 11egister L;tice period, and in any event add to or include in the full-power license the same license condition authorizing the transactions,

I Because of financial considerations discussed in the l

applications, it is imperative that the transactions be approved as soon as possible.

Accordingly, we ask that you publish at this

juncture the Federal Register notice (s) containing a determination that the applications involve no significant hazards consideration.

Toledo Edison Company for operation of the Beaver Valley Power ' Station Unit 2,

located in Beaver

County, Pennsylvania, or if that license has been superseded by a

full-power license, issuing the amendment to the full-power license.

If the l

amendment is issued to NPF-64, the provision added to NPF-64 will be subsequently incorporated into the full power license.

We believe this procedure satisfies the NRC's regulations and is the most efficient course of action.
