October 16, 1987 ORDER (Admitting Two Remanded Contentions; Scheduling)
In its Decision of October 1, 1987, ALAB-875, 26 NRC _,, the Appeal Board ordered that, on remand, this Licensing Board should admit for litigation NECNP Contention I.V. and IV, which had been rejected in LBP-82-76,16 NRC 1029,1067-68,1075 (1982).
Accordingly, NECNP Contentions I.V. and IV are admitted as issues in controversy. Discovery shall be commenced on October 26 and be completed by December 28, 1987. On or before December 7,1987, Applicants, the Staff and NECNP will notify the Board whether or not each will file a motion for summary disposition.
(Parenthetically,the In LBP-82-106, 16 NRC 1649, 1659 (1982), the Licensing Board reaffirmed its ruling rejecting NECNP Contention I.V.
