NRC STAFF RESPONSE TO APPLICANTS' OBJECTION IN THE NATURE OF A MOTION IN LIMINE TO A PORTION OF SEACOAST ANTI-POLLUTION LEAGUE TESTIMONY OF DAVID P. MACDONALD ON SAPL CONTENTIONS 8 AND 8A RELATIVE TO THE TOWN OF RYE in their October 1,1987, motion Applicants object to the admission of that portion of the prefiled testimony of David P.

MacDonald concerning the need to include the Isles of Shoals in the emergency plan for Seabrook. The Staff supports the Applicants' motion.

The Isle of Shoals is located beyond the emergency planning zone for Seabrook Station and Commission regulations at 10 C.F.R. 9 50.47 do not require that emergency plans extend beyond the emergency planning zone.

For this reason the Staff supports the Applicants' motion to exclude the subject portion of Mr. MacDonald's prefiled testimony.
