' LOWN OF NEWBURY'S MOTION FOR TIME EXTENSION FOR ANSWER 10 "Applicantu Motion for Vacation of Stay", dated September 21, 1987 The Town of Newbury moves the Cannission extend the time deadline of October 9, 1987, as stated in the Canmtission's ORDER of September 24, 1987, requesting answers to the " Applicants' Motion for Vacation of Stay".

There are two reasons for our motion for extension of time:

First, we did not receive the ORDER. We did check by phcne with your Docketing and Service Section, Emile Julian, and it was confinned that we are on that service list and should have received the order, but we did not. Therefore, we were not aware of the coment deadline until af ter it had passed.

Second, the Utility Plan for Massachusetts Cannunities is ten (10) volumes in length. We are avery snall town with basically a volunteer, part time government with very little support staff. Therefore, we feel that in order te read and review with any thoroughness whatever, a longer period than three weeks is necessary. We have done our best in this area, in view of the fact that h

we feel it necessary to attach our coments to this motion, given that the 7@

ORDER States that the Comtission's staff answer will be nade and delivered ob on October 20, 1987.

order by deciding whether the Seabrook Plan for Massachusetts Cannunities mo nects the two criteria previously (MEMORANDUM AND ORDER CLI-87-03) stated, 52 1)is this a bona fido utility plan? and 2) is adequate emergency planning 08 "at least in the realm of the possible".
