s Senior Vice President, Operations Thank you for your letter dated January 5,1989 in.responseL to the items which we brought to your attention in our letter, Notice of Violation, and report dated December 15, 1988.
We disagree with the statements made in your letter in which'you claimed that the procedures described ~in the Measurex Radiation Safety Manual were not license requirements, and as a result, no violation of the NRC general license-had occurred.
In your letter, you also state that Measurex had represented the' Manual to the California Department of Health Services as only " internal.
procedures and policies concerning radiation safety" which were submitted only as part of your training program.
However, Dr.'G. Wang and Mr. R. Funderburg of the Department's Radiologic Health Branch have confirmed that Amendment 51 of the California license, which incorporated your letter and Manual dated December 5, 1985 by reference in License Condition 13(i), was approved by the California Department of Health Services on the basis that the instructions described in the Manual were operational procedures that Measurex was required to follow in using or servicing sensors containing licensed material.
Consequently, your response to the letter and Notice of Violation dated December 15, 1988 was determined to be unacceptable, and must be resubmitted in'accordance with the provisions of 10 CFR P,,201 as stated in the enclosed Notice..If you-have any questions on this matter, we will be glad to. discuss them with you.
