Petitions filed on flovember 29, 1985, presenting allegations of inadequate leak rate testing by NRC, referenced a report by hin entitled, " Critique of

Containment System Test Requirements." Reytblatt asserted that Denton, in j

his Director's Decision regarding these petitions, referred to Reytblatt's report as proprietary.

Reytblatt alleged that his Critique Report was a public document, and this false statenent was purposely made by Denton to j

avoid a need to address the substance of Reytblatt's arguments contained in 1

his Critique. Reytblatt furthernare clained that Denton refused to i

l consider the evidence in his Critique Peport, Conclusinn_

This OTA inquiry resulted in the following conclusions:

Reytblatt's contention that his report, " Critique of Containment Systens Leak Rate Testing Requirements," was not proprietary and a public document et the time of the f!RC review of the 10 CFR

? ?06 petitions was substantiated. The Ravthlatt Critique was proprietary at the time of its initial subnission in April 1983, but the proprietary restriction was later lif ted by Raytblatt.

Reytblatt's allegation that Denton, in his t? arch 16, 1984 Di rector's Decision, f alsely stated that Reythlatt's report, " Critique of Containment Systens Leak Rate Testing Requirements," was proprietary is unsubstantiated. The Director's Decision (at page P) is ' accurate when it states that various submittals made between Nav 199? and Julv 1983 (including an early copy of the Critioue) "were u'nsolicited and' classified by Dr. Reytblatt as proprietary."

.There is no express reference to Reytblatt's Critique (as resubmitted with the November.?o, 1983 petitions) as being either a proprietary or public document.

1 Reytblatt's contentions that Denton deliberately characterized the 1

Critique as proprietary to avoid. addressing it and then refused to l

consider the petitioner's evidence are unsubstantiated. The information developed during this investigation support the coment at page 5 of the Director's Decision that the NRC staff was aware of the work of Reytblatt which was referred to the 10 CFR ?.206 Petitions and the coment at page 8 that the submittal was reviewed.
