James A. FitzPatrick Nuclear Power Plant Docket No. 50-333 Proposed Changes to the Technical Specifications Regarding Scram Discharge System operability (JPTS-87-004)

Dear Sir:

s This application for an amendment to the James A.

FitzPatrick Technical Specifications proposes to delete one of l

the surveillance requirements associated with the scram discharge system.

This change will delete the requirement to manually scram the reactor from a control rod configuration of less than or equal to 50% rod density, once each operating cycle.

This requirement was intended to verify the operability of the scram discharge system.

However, operability is adequately demonstrated by other surveillance requirements which do not involve a scram.

This change is consistent with a philosophy of reducing the number of unnecessary challenges to the reactor protection system and the resulting transient.

Other changes are made to correct typographical errors which exist on this page of the Technical Specifications.

Enclosed for filing is the signed original of a document entitled " Application for Amendment to operating License," with Attachments I and II thereto, comprising a statement of the proposed changes to Appendix A of the Technical Specifications and the associated Safety Evaluation.

In accordance with 10 CFR 170.12, a check in the amount of

$150.00 is enclosed as payment of the application fee for the review of the proposed changes to the Technical Specifications.

In accordance with 10 CFR 50.91, a copy of this application and the associated attachments are being provided to the designated New York State official.
