Applicants seek to exclude the testimony of a teacher panel,

presenting the views of approximately 547 teachers throughout the emergency planning zone, that a substantial rajority of teachers will not be available to assemble, transport, and remain with students at decontamination centers during an actual emergency at Seabrook.

. Applicants, therefore, baldly claim that teachers assigned emergency. response roles under the NHRERP are incompetent to express a-their own: views on teacher av ail abil it y to carry out these assignments.
Apparently, Applicants take the position that their own robust testimony,. prof err ed by " experts" employed to support the NHRERP, can provide more accurate information on teacher availability F to this Board.
The Town of Hampton suggests that Applicants' position

- is incorrect as a point of evidence, raises due. process concerns by and denying a hearing to those assigned emergency response roles,
- would result in' exclusion of the most relevant testimony concerning _
teacher availability.

New Hampshire's Emergency Management Agency has also apparently conceded that there are no provisions in the NHRERP to compensate or substitute f or a lack of available teachers and that that of fice has conducted no surveys to determine how many teachers m ay volunteer to assume the responsibilities in the event of an actual emergency at seabrook.

- Finally, the Limerick decision relied upon by Applicants otherwise f ails to support Applicants' motion in limine since that decision f ollowed a full evidentiary hcaring.

Apparently, in Limerick, no motion to exclude testimony in advance of the hearing was made, and none ordered.
